Scott Patrick Kozak of Highlands Ranch, Colorado was suspended by FINRA for two years for allegedly engaging in private securities transactions, a form of broker misconduct known as selling away. While employed by Cetera Advisors LLC, Scott Kozak allegedly engaged in three sets of private securities transactions without written notice or approval from his member firm. According to FINRA, Mr. Kozak solicited customers and registered representatives to invest approximately $1.1 million in two companies’ securities. Mr. Kozak invested his own funds in the companies, as well. Additionally, Mr. Kozak was found to have solicited investments in promissory notes from seven Cetera customers. These customers collectively invested $380,000 in the promissory notes. Without admitting or denying FINRA’s findings, Scott Kozak consented to the sanctions, was assessed a deferred fine of $10,000 and has been suspended from association with any FINRA member for two years.
